Legal Genie™ will fill out the paperwork you need to complete the divorce process. The divorce process consists of three (3) steps. The Basic Divorce package includes two (2) telephone consultations (up to 30 minutes each) with an attorney on Legal Aid Society of Orange County’s California State Bar-certified Lawyers Referral Service panel. You may choose to use your two (2) telephone consultations at any time during the process but the descriptions below show where you may want to get your consultations.
All steps are to be completed regardless of whether you are the Petitioner or the Respondent. To be sure that you are selecting the correct questionnaire, a list of the steps and their descriptions appear below:
Step 1 (Summons and Petition/Response):
Use this questionnaire if you would like to start a divorce or respond to a divorce. If you have your financial information on hand (wages, assets, debts, etc.) you may also want to complete Step 2 (Declaration of Disclosure) at this time. Step 1 and 2 can be filed at the same time but it is not mandatory. You may choose to complete Step 2 within 30 days of serving the other party with the documents from Step 1.
After you complete the forms for Step 1, you may choose to contact us so we can connect you to an attorney on our LRS panel for your first of two (2) telephone consultations (up to 30 minutes each). The attorney will consult with you by telephone, review your documents and can answer your questions.
Step 2 (Declaration of Disclosure):
Both parties are required to disclose their financial information to each other. Disclosures must be done at the start of the divorce (preliminary declaration of disclosure) and again at the end of the divorce (final declaration of disclosure). Aside from a single box that you will manually mark, the forms are identical for both preliminary and final declaration of disclosure. Use this questionnaire to create your preliminary declaration of disclosure then simply, return and revise your answers as needed to create the final declaration of disclosure.
NOTE* Only a preliminary declaration of disclosure is required in the case of a default judgment.
Step 3 (Judgment and Notice of Entry of Judgment):
Use this questionnaire to complete your divorce. You can file Step 3 forms, no sooner than 30 days after you serve your spouse with the Step 1 forms. Once these forms are completed, your divorce may be finalized six months from the date the divorce petition was served. After you complete the forms for Step 3, you may choose to contact us so we can connect you to an attorney on our LRS panel for your second of two (2) telephone consultations (up to 30 minutes each). The attorney will consult with you by telephone, review your documents and can answer your questions.
All forms needed to get an Order to Show Cause or to respond to an OSC (to ask for or ask to change spousal support, property orders, child support, custody, visitation and/or attorney fees and costs). This package also comes with the forms you need to fill out the required financial paperwork (if you asked for child support, spousal support or attorney fees and costs).

Legal Genie™ will fill out the forms needed to file an Order to Show Cause (OSC) or respond to an OSC that someone else has filed. An OSC enables you to do two (2) things: 1) request court orders for the first time (or respond) and 2) request a modification of an existing court order (or respond)
1. Requesting Orders for the First Time
You cannot file an OSC without an existing case number. You can file an OSC either at the same time, while your case is pending, or after you have a judgment in one of the following case types: Divorce, Legal Separation or Paternity, As soon as you have an existing case type, you can use that case number to file an OSC.
2. Requesting a Modification
File an OSC if you already have orders from the court and you want to change them. For example: The court has awarded you $500 per month in child support based on a 50/50 custody arrangement. The other party has gone from spending 50% of the time with the child to 10% of the time. The amount of child support should reflect the current 90/10 custody arrangement. You may file an OSC to change the existing court order.
You may also file an OSC to ask for orders that were not included in a judgment you have already received. For example: You were involved in a divorce that has been finalized. You did not seek spousal support at the time of the divorce but are now in need of the financial assistance. You may file an OSC to request that spousal support be included in your divorce judgment.
This is a Basic Divorce package with the added feature of an Order to Show Cause (OSC). Adding an OSC to your divorce is beneficial if you want more immediate court orders for child support, child custody, spousal support, etc. With the OSC you can have a hearing on these issues in a shorter period of time then you would if you were to wait for the regular divorce proceedings.
